1) Scope

1.1These terms and conditions of Digital Flexible UG (limited liability) (hereinafter “wunschpaket”) apply to all contracts concluded by a consumer or entrepreneur (hereinafter “Customer”) with wunschpaket regarding customs and shipping services. This shall not allow the customer’s own terms and conditions to be included, unless otherwise agreed.

1.2A consumer within the meaning of these General Terms and Conditions is any natural person who concludes a legal transaction for a purpose which cannot be attributed to his commercial or independent professional activity. An entrepreneur within the meaning of these General Terms and Conditions is any natural or legal person or partnership with legal power acting in the exercise of its independent professional or commercial activity when concluding a legal transaction.

2) Description of benefits

2.1 Customers from Switzerland can choose products on german online shops and send them to us via the order form under https://wunschpaket.ch/en/order.

2.2 We check the goods for availability, delivery times and the possibility of customs clearance to Switzerland.

2.3 The customer will receive an individual offer from us for customs clearance and shipping. This includes the following points:

  • Shipping costs in Switzerland
  • Customs clearance: customs clearance, customs duties, Swiss VAT

2.4 After acceptance and payment of the offer by the customer, the customer receives an individual delivery address in Germany for the order.

2.5 The customer orders the goods to the individual delivery address and sends us all necessary invoices for customs clearance. The goods are delivered to our forwarder. He prepares all necessary customs documents and declarations. The goods are then cleared through customs and handed over to a Swiss shipping service provider.

3) Conclusion of the contract

3.1 The offers drawn up by wunschpaket do not constitute binding offers, but serve to make a binding offer by the customer.

3.2The customer can submit the offer via the online order form integrated on the website. After entering his personal data, the customer makes a legally binding contract offer with respect to the goods and customs services contained in the shopping cart by clicking on the button that completes the ordering process.

3.3 Desired package may accept the customer’s offer within five days,

  • by sending the customer a written order confirmation or an order confirmation in text form (fax or e-mail), wherein that the receipt of the order confirmation by the customer is decisive, or
  • by supplying the ordered goods to the customer, in so far as the receipt of the goods by the customer is decisive, or
  • by asking the customer to pay after placing his order.

If several of the above alternatives are available, the contract shall be concluded at the time when one of the above alternatives first occurs. If the offer of the customer does not accept the offer of the customer within the aforementioned period, this shall be deemed to be a rejection of the offer with the result that the customer is no longer bound by his declaration of intent.

3.4 The period for acceptance of the offer begins to run on the day after the customer has sent the offer and ends at the end of the fifth day following the dispatch of the offer.

3.5When submitting an offer via the online order form of wunschpaket, the contract text of wunschpaket is stored and sent to the customer after sending his order together with these GTC in text form (e.g. e-mail, fax or letter). In addition, the contract text is archived on the website of wunschpaket and can be accessed by the customer via his password-protected customer account free of charge, specifying the corresponding login data, provided that the customer has created a customer account on the website of wunschpaket before sending his order.

3.6Before submitting the order via the online order form of wunschpaket, the customer can continuously correct his entries via the usual keyboard and mouse functions. In addition, all entries before the binding submission of the order are displayed again in a confirmation window and can also be corrected there by means of the usual keyboard and mouse functions.

3.7 The German language is available for the conclusion of the contract.

3.8Order processing and contact ingestion take place via e-mail and automated order processing. The customer must ensure that the e-mail address provided by him for order processing is correct, so that the e-mails sent by the desired package can be received at this address. In particular, when using SPAM filters, the customer must ensure that all e-mails sent by the request package or by the third party responsible for order processing can be delivered.

4) Prices and terms of payment

4.1 The prices quoted include the shipping costs in Switzerland and the customs duties with customs clearance, customs duties, Swiss VAT. If applicable, additional delivery and shipping costs will be specified separately in the respective offer.

4.2 The customer has at his disposal various payment options, which are indicated on the website of wunschpaket.

4.3 If advance payment has been agreed, payment is due immediately after conclusion of the contract.

4.4 Stripe Payments
The payment methods credit card payment, Apple Pay, Google Pay are processed in cooperation with Stripe Payments Europe, Ltd., c/o A&l Goodbody, Ifsc, North Wall Quay, Dublin 1, Ireland (‘Stripe’), subject to the Stripe Terms of Use, under https://stripe.com/de/terms to which the Seller assigns his payment claim. Stripe withdraws the invoice amount from the customer’s specified credit card account or bank account. In the case of assignment, only Stripe with debt-relieving effect can be performed. The credit card will be debited immediately after sending the customer order in the online shop or 2 days by SEPA direct debit. The seller remains responsible for general customer enquiries, e.g. for goods, delivery time, shipments, returns, complaints and shipments or credit memos, even when selecting payment methods via Stripe.

5) Information on customs clearance

5.1The importation of goods subject to authorisation is excluded. In addition, we exclude the following product groups.

  • Food
  • Salt in the form of table salts, Schüssler salts (except for bath salt and cosmetic salt mixtures)
  • Medications
  • Alcohol in any form
  • Narcotics
  • Tobacco and other nicotine-containing products
  • Animals and furs of all kinds
  • Plants and plant seeds
  • Plant protection products, fertilizers, biocidal products
  • Precious metals
  • Real gems
  • Dangerous substances and preparations
  • Weapons and parts thereof
  • Coins, banknotes
  • Cultural
  • Goods infringing intellectual property

5.1 Granting of customs power of attorney

The customer grants a customs authorisation for each order request package. This is valid for the respective order and expires with the successful customs clearance and delivery of the goods to the customer.

The customer, who orders on behalf of a third party, assures that he is authorized by the customer to grant the power of attorney.

By placing an order, the customer assures that he or a third party who has authorised him is the buyer of the goods to be declared at customs.

The customer as well as the third party who authorises the customer to grant the power of attorney becomes the “declarant” by placing the order in the customs declaration.

The declarant is the person who, in his own name, submits the customs declaration.t.

6) Terms of Delivery and Shipping

6.1The delivery of goods is carried out regularly by shipping route and to the delivery address specified by the customer. When processing the transaction, the delivery address specified in the order processing of the desired package shall prevail.

6.2 If the transport company sends the shipped goods back to the desired package, since delivery to the customer was not possible, the customer covers the costs for the unsuccessful shipment.

6.3 In principle, the risk of accidental loss and accidental deterioration of the goods sold shall pass to the responsible transporter with the abandonment of the goods for dispatch or with handover.

6.4 Self-collection is not possible for logistical reasons.

7) Liability for defects and warranty claim

7.1 The customer must inspect the goods on delivery and report the package of wishes within seven days. Liability only applies to damages that are the responsibility of wunschpaket. The value of the liability is limited to the purchase price.

7.1 Warranty claims must be made directly to the original retailer. Wunschpaket offers to return goods via the return service. For each return, an offer is made with return customs clearance and shipping costs. This must be accepted and paid by the customer.

8) Applicable law, place of jurisdiction

8.1 If the customer acts as a consumer, all legal relationships between the parties shall be governed by Swiss law to the exclusion of the UN Convention on the International Purchase of Movable Property and shall be the exclusive place of jurisdiction for all disputes arising from this contract.

8.2 If the customer acts as an entrepreneur, the exclusive place of jurisdiction for all disputes arising from this contract is the domicile or place of business of the desired package.
